Collection and Use of Information
Account Information. If you create an account by registering with us (“Account”), we’ll collect certain information that can be used to identify you (“PII”), such as your full name, email address, and phone number. You will also be required to provide us with credit card, bank account details or other payment information to process applicable payments relating to use of the Services (“Billing Information”).
Your Third-Party Services Log-in Information. Our Services provides a software solution to help you manage your information technology performance information from third party service providers and to this end, we will collect your login credentials and other access data (“Third Party Services Access”) to access the messages, log files and alerts from those third-party service providers.
“Web beacons” (also known as web bugs, pixel tags or clear GIFs) are tiny graphics with a unique identifier that may be included on our Services for several purposes, including to deliver or communicate with cookies, to track and measure the performance of our Service, to monitor how many visitors view our Services, and to monitor the effectiveness of our advertising. Unlike cookies, which are stored on the user’s hard drive, web beacons are typically embedded invisibly on web pages (or in an e-mail).
Information Related to Use of the Services. Our servers automatically record certain information about how a person uses our Services (we refer to this information as “Log Data”), including both Account holders and non-Account holders (either, a “User”). Log Data may include information such as a User’s Internet Protocol (IP) address, browser type, operating system, the web page that a User was visiting before accessing our Services, the page or features of our Services to which a User browsed, and the time spent on those pages or features, search terms, the links on our Services that a User clicked on and other statistics. We use Log Data to administer the Services and we analyze (and may engage third parties to analyze) Log Data to improve, customize and enhance our Services by expanding their features and functionality and tailoring them to our User’s needs and preferences. We may use a person’s IP address to generate aggregate, non-identifying information about how our Services are used.
Feedback. To the extent you choose to provide any PII with the feedback, suggestions, recommendations and/or comments with respect to our Services, we will collect such information.
Information Sent by Your Device. We collect certain information that your device (such as mobile phone, iPad, computer, etc.) sends when you use our Services, like a device identifier, user settings and the operating system of your device, as well as information about your use of our Services.
Use of Information Collected
Our primary goals in collecting information are to provide and improve our Services, to administer your use of the Service (including your Account, if you are an Account holder), and to enable you to enjoy and easily navigate our Services. We will use your PII:
To operate and provide Services. We collect and use your PII and other information, such as your Third-Party Services, to operate and provide you with our Services in accordance with our legitimate interests. In addition, we will use your Billing Information to process your payment for the use of our Services.
For informational, promotional and survey purposes. We may use your PII to inform you of our product and service offerings, subject to your ability to opt-out of receiving such information as described below. We may also contact you via surveys to conduct research about your opinion of current Services features or of potential new services. These activities are based on our legitimate interest in undertaking marketing activities to offer you products or services that may be of your interest.

We use this information to maintain and improve the content, design, usability and quality of the Services; to improve your user experience; to generate and provide statistics regarding use of the platform and the Services to deliver customized content and advertising to users whose behavior indicated that they are interested in a particular subject area, and to develop new product and service offerings. These activities are based on our legitimate interest in improving the functionalities of the Services.

Third-party vendors have access to and may collect information only as needed to perform their functions and are not permitted to share or use the information for any other purpose. They are also required to follow the same data security practices that we ourselves adhere to, and they may be located inside or outside of the European Economic Area (“EEA”).
The length of time we retain your PII depends on a number of factors relating to our business needs and legal requirements. In general, we will keep PII for such time as required by applicable law or to exercise our legal rights.
Your Rights and Choices
We offer you choices regarding the collection, use and sharing of your PII and we’ll respect the choices you make. Please note that if you decide not to provide us with the PII that we request, you may not be able to access all the features of the Services. You may also be entitled to request copies of PII that you have provided to us in a structured, commonly used, and machine-readable format and/or request us to transmit this information to another service provider (where technically feasible).
Data Retention and Erasure. We generally retain your PII for as long as is necessary for the performance of the contract between you and us and to comply with our legal obligations. If you no longer want us to use your information to provide the Services to you, you can request that we erase your PII and close your Account. Please note that if you request the erasure of your PII:
- We may retain some of your PII as necessary for our legitimate business interests, such as fraud detection and prevention and enhancing safety.
- We may retain and use your PII to the extent necessary to comply with our legal obligations.
- Some copies of your information (e.g., log records) may remain in our database, but are disassociated from personal identifiers. Because we maintain the Services to protect from accidental or malicious loss and destruction, residual copies of your PII may not be removed from our backup systems for a limited period of time.
Withdrawing Consent and Restriction of Processing. Where you have provided your consent to the processing of your PII by BigPanda, you may withdraw your consent at any time by changing your Account settings or by sending a communication to BigPanda specifying which consent you are withdrawing. Please note that the withdrawal of your consent does not affect the lawfulness of any processing activities based on such consent before its withdrawal. Additionally, in some jurisdictions, applicable law may give you the right to limit the ways in which we use your PII, in particular where (i) you contest the accuracy of your PII; (ii) the processing is unlawful and you oppose the erasure of your PII; (iii) we no longer need your PII for the purposes of the processing, but you require the information for the establishment, exercise or defense of legal claims; or (iv) you have objected to the processing pursuant to your right to object to processing (below) and pending the verification whether the legitimate grounds of BigPanda override your own.
Objection to Processing. In some jurisdictions, applicable law may entitle you to require BigPanda not to process your PII for certain specific purposes (including profiling) where such processing is based on legitimate interest. If you object to such processing, BigPanda will no longer process your PII for these purposes unless we can demonstrate compelling legitimate grounds for such processing or such processing is required for the establishment, exercise or defense of legal claims.
